Despite the blatant similarities as long as they make it diverse enough and don't obviously reference it, Nintendo can't sue them. Even if it was a somewhat shitty move, the reason Pokemon Nuclear and all those other fan games got takedown notices is because they straight up used the IP of Pokemon.

It's not only Nintendo taking action. Yostar may take action as well if they are protective of their franchises. One reason there are no Kancolle (I know this is Azur Lane, but I'm giving another example) fan games at all, despite its massive fan base, is because Kadokawa is protective of it and doesn't want any made.

Know this is a bit of a necro, but the reason you would not see this, even in a "Cancel mode" is because you can't copyright gameplay. This is why Genshin Impact is so popular despite there having some people trying to cancel it back in 2019 or 2020 or whatever, I don't play the game to know its history but I remember people complaining it was just Breath of the Wild gameplay.
