People probably won't be that angry if they didn't try to get people to pay for it. Since memes can be considered a derivative work, they might get in trouble if ZUN decided to do something about it. AFAIK memes can be trademarked, Grumpy Cat for example, but that was because they actually own Grumpy Cat itself.

I mean, I imagine people would still have gotten angry because the original ASCII artist and the illustrator would be far more valid candidates for trademarks, yet they had sided with allowing anyone to freely use yukkuris - given how much people care about crediting the original artist, that alone would have caused stir.
Ah, right then. I have to admit, trying to trademark anything Touhou-related sounds like an exercise in futility if you're not ZUN. Hell, it'd proably be an exercise in futility if you ARE him.
