Well, there's a number of indicators: Firstly, we must keep in mind that most murders are committed by relatives and associates, people who are close to one another. We can rule out those dead by the time Lelouch puts on the Emperor Hat. And the perpetrator must have had the necessary physical brawn to jam a cross through an upper body. Kallen, Tohdoh and Suzaku spring to mind, among others. Furthermore, they had enough sense of drama to kill him with a red cross, and then to tip over the black king on the chessboard. Kallen, Tohdoh and Suzaku are out. Note furthermore that Lelouch is sitting in a high-backed (and intact) chair, though he was evidently stabbed from behind. He could not have been stabbed from above when he leaned forward make a move, because the chessboard is placed close to his right, so he must have been moved to the chair with the cross sticking through his back, which would hardly be conducive to his survival. And consider the placement of Lelouch's right hand: He is not dead enough to overlook the hot leg on his armrest, and the relatively modest bloodstains on his Emperor Suit support the conclusion that he hasn't been stabbed for very long time. Lastly, and this one is easy to miss, there is a hint roughly in the left of the picture. It has prior experience with disposing of bodies, can beat up thugs unarmed, was a close confidant of the victim, and is at the crime scene before the victim is even dead. While high heels would surely hinder C.C. in sticking a cross through anyone, there is nothing to suggest she was acting alone. It would also explain Lelouch's uncharacteristic touching of her leg in his final moments: Not an attraction, but a last, weak attempt to wrest immortality from his enemy.
