Does it even have to be either of those? As a commission someone could have simply said "Hey, I really liked this drawing. Could you draw this, but with these other characters?"

Commissioner here. This is not AI. And I did use that as a reference. If you ever commissioned artists you'd know that's actually common. Clients bring reference poses and art all the time to commission artists. This isn't even a 1:1, there are differences if you look.
